Object of the treatment

  

The Data Controller processes personal, identifying, and non-sensitive data (such as name, surname, tax code, VAT number, email, telephone number - hereinafter, "personal data" or "data") communicated by you when registering on the owner's website and/or when subscribing to the newsletter service offered by the owner.

Purpose of the treatment

​

  Your data are processed:  

  1. A) without your express consent (art. 6 letter b, and GDPR), for the following Service Purposes:

– fulfill the pre-contractual, contractual, and tax obligations deriving from existing relationships with you;

– fulfill the obligations established by law, by a regulation, by community legislation, or by the Authority;

– prevent or detect fraudulent activity or abuse harmful to the website;

– exercise the rights of the Owner, for example, the right of defense in court.

  1. B) Only upon your specific consent (Article 7 of the GDPR) for the following Marketing Purposes:

send via email newsletters, commercial communications and/or advertising material on products or services offered by the Owner.

Please note that if you are already our customer, we will be able to send you commercial communications relating to the Controller's services and products similar to those you have already used, unless you disagree (Article 4 of the Privacy Code).


Processing methods

 

The processing of your data is carried out through the operations indicated in art. 4 no. 2) GDPR and precisely: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation, and destruction of data. Your data is subjected to paper, electronic and/or automated processing. The Data Controller will process data for the time necessary to achieve the purposes for which they were collected and, in any case, for no more than 10 years from the termination of the relationship for the Service Purposes and no more than 2 years from the collection of data for the Marketing Purposes.

Data access

  

The data may be made accessible for the purposes referred to in art. 2.A) and 2.B):

– the Data Controller's employees and internal collaborators as persons in charge and/or internal data processors and/or system administrators;

– to the Data Controller's external collaborators (for example, for support activities in the feasibility study of the customer's project, for technical project management activities) or to third parties (for example, providers for the management and maintenance of the website, suppliers, credit institutions, professional firms, etc) who carry out outsourced activities on behalf of the Data Controller as external data processors.

Data communication

  

  Without your express consent (art. 6 b) and c) GDPR), the Data Controller may communicate your data for the purposes referred to in art. 2.A) to supervisory bodies, judicial authorities, and all other subjects to whom the communication is mandatory by law for the accomplishment of the aforementioned purposes. Your data will not be disclosed.

Data transfer

  

The management and storage of data will take place on servers of the Data Controller and third-party companies,located within the European Union. The data will not be transferred outside the European Union. 

In any case, the Data Controller, if necessary, will have the right to move the location of the servers to Italy and/or the European Union and/or non-EU countries. In this case, the Data Controller ensures from now on that the transfer of data outside the EU will take place in compliance with the applicable legal provisions by stipulating, if necessary, agreements that guarantee an adequate level of protection or by adopting the standard contractual clauses envisaged by the European Commission.

Nature of data provision and consequences of refusal to respond

  

 The provision of data for the purposes referred to in art. 2.A) is mandatory. In their absence, we will be able to guarantee you neither the registration on the site nor the Services of the art. 2.A). The provision of data for the purposes referred to in art. 2.B) is instead optional. 

It will therefore be possible to decide not to provide any data or to subsequently deny the possibility of processing data already provided: in this case, you will not be able to receive newsletters, commercial communications, and advertising material relating to the Services offered by the Data Controller. In any case, you will continue to be entitled to the Services under art. 2.A).

Rights of the interested party

As an interested party, you have the right, according to art. 15 GDPR of:

  1. obtain confirmation of the existence or not of your data, even if not yet registered, and their communication in an intelligible form;

  2. get info about: a) the origin of the data; b) the purposes and methods of the processing; c) the logic applied in case of treatment carried out with the aid of electronic instruments; d) the  identification details of the owner, of the managers and the designated representative according to art. 5, paragraph 2 of the Privacy Code and art. 3, paragraph 1, GDPR; e) the subjects or categories of subjects to whom the data may be disclosed or who can learn about them as designated representative in the territory of the State, managers or agents;

  3. get: a) updating, rectification or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this requirement is proving impossible or involves the use of means manifestly disproportionate to the protected right;

  4. object, in whole or in part: a) for legitimate reasons, to the processing of your data, even if pertinent to the purpose of the collection; b) to the processing of data concerning you for sending advertising material or direct sales or for carrying out market research or commercial communication, through the use of automated call systems without the intervention of an operator by email and/or by traditional marketing methods by telephone and/or paper mail. Please note that the right of opposition of the interested party, set out in point b) above, for direct marketing purposes through automated methods extends to traditional ones and that, in any case, the possibility remains for the interested party to exercise the right of opposition also only partially. Therefore, the interested party can decide to receive only communications using traditional methods or only automated communications or neither of the two types of communication.

You also have the rights as provided by articles 16-21 GDPR (Right of rectification, right to be forgotten, right of limitation of treatment, right to data portability, right of opposition) and the right of complaint to the Guarantor Authority.

Minors

 The Site and the Services of the Data Controller are not for minors and the Data Controller does not intentionally collect information relating to minors. In the event that information on minors is involuntarily recorded, the Data Controller will promptly delete it, at the request of the users.
